Creating a custom-tailored prenuptial agreement

On Behalf of | Jul 17, 2022 | Prenuptial Agreements

When a couple marries, they are not intending for their relationship to end at some point in the future. However, divorce does happen, and it may be prudent for a Virginia couple to plan for this possibility by creating a prenuptial agreement before the wedding. A prenup outlines how property division will work in the event of a divorce and how a couple can protect their long-term financial interests. However, it can be difficult to initiate this conversation.

A difficult conversation

It is not always easy to bring up the subject of a prenuptial agreement. It can be awkward to discuss the possibility of divorce before marriage, but these contracts are especially important when one spouse has children from a previous marriage, there is significant financial inequity between the spouses or one spouse has been divorced before. If it is difficult to have this conversation, it will help to make a list of reasons why this could be a prudent step.

After explaining the benefits, it may also be helpful to keep the conversation completely about business and finances. Discussing a prenup can be awkward, but it doesn’t have to be personal or accusatory. When approached the right way, this can be a beneficial conversation for a couple about to marry.

Confidence in the future

A prenup is a way for a Virginia couple to protect their interests before walking down the aisle. While it is not always easy to approach this subject, it can be beneficial for both parties to consider the benefits of this contract. An assessment of the specific circumstances can identify what elements will create the strongest and most practical prenuptial agreement.
